PERSONAL CHEF SERVICES CONTRACT

The following is a contract for the personal chef services of EETS ATX LLC

Thank you for selecting EETS ATX  LLC as your personal chef service. My goal is to provide you with delicious food on an ongoing basis with a nutritional food plan tailored to your personal goals. Together, we have completed a consultation or communicated in order to assess your needs as well as preferences. EETS ATX  is a professional personal chef service owned and operated by Chef Mark Miller. With respect to all parties involved this business policy statement is furnished to clients so they aware of how this business operates.

 

DESCRIPTION OF SERVICES:

The Clients agree:  I / We hereby employ Chef Mark Miller (THE CHEF) for the purpose of providing regularly scheduled (i.e. twice per week, weekly, biweekly, etc.)  private chef services.  

 

NOT Medical Advice.

I/We understand and agree that Mark Miller is not a licensed medical physician or a registered dietitian, and he has not promised, shall not be obligated to and will not: (1) advise the Client to change or alter his/her medication prescriptions; (2) provide medical advice that would substitute for the advice and medical oversight of the Clients’ physicians; or (3) act as a therapist, providing psychological counseling, psychoanalysis or behavioral therapy.   

 

I/We understand and agree that the information presented on EETSATX.com and Chef Mark is in no way intended as medical advice or as a substitute for medical treatment. This information should only be used in conjunction with the guidance and care of your physician. Consult your physician before beginning any diet, nutrition, or fitness plan offered through EETSATX.com. Your physician should allow for proper follow-up visits and individualize your diet, nutrition, or fitness plan as appropriate. Nothing stated or presented on EETSATX.com is intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or another qualified healthcare provider if you have any questions regarding a medical condition, your diet, nutritional supplements, an exercise regimen, or any other matter related to your health and well-being.

 

Diabetes.

Our meal delivery program is not intended to meet the needs of individuals living with diabetes. If you are an individual living with diabetes, you agree to participate in a meal delivery program only with the express consent of your physician. Our meals are intended for use only by healthy adult individuals. They are not intended for use by minors, pregnant women, or individuals with any type of health condition which could be adversely affected by diet.

Menu Approval Process

Both parties agree that each week's menu will be sent to the client for approval. 

Payments

I / We agree to the following standard order for $300 weekly plus taxes, and the cost of food and supplies. Payable by PayPal, Venmo or Zelle. 

I/We agree to pay the standard order fee of $300 weekly + TAXES after confirming each week's order and upon receiving the weekly invoice. I/We are in agreement that this will be considered a standard order and that the $300 weekly prep fee will not change even if the size of the order decreases.

 

I/We agree to reimburse the chef for the full cost of groceries on our cook/delivery date.

Pauses / Cancellations / Refunds.

I/We will provide one (1) week’s notice if we will not utilize Chef Mark's  services in a given week (pause). 

I/We will provide a minimum of two (2) weeks notice if we choose to end this contract (cancel).  

 

Pauses must be submitted before our weekly deadline which is every Friday at 6:00 PM. After our cutoff time orders enter the production schedule and are unable to be removed. Refunds will not be issued for meals in production.

 

Due to the short turn-around for orders, once the payment is processed no refunds will be provided. Refunds will not be issued for meals that have been delivered. Refunds will not be issued for meals in production.

Statement Regarding Food Allergies.

If you have any allergies, you must notify Chef Mark prior to making an order. If you are a current EETS ATX Meal Prep customer, and discover that you have an allergy, or develop an allergy, you must notify EETS ATX immediately. Failure to notify Chef Mark  of new and existing allergies will absolve EETS ATX  of any and all damages.

 

The eight most common food allergens are as follows: milk, eggs, peanuts and tree nuts (such as almonds, cashews, and walnuts), fish (like bass, cod, flounder), shellfish (including crab, lobster, and shrimp), soy and wheat. Please be advised that some meals may contain these allergens and also contain the no-calorie sweetener, stevia. If you’re allergic to any of these items, you should know that we prepare foods in our kitchens with these ingredients, and while we make every effort not to do so, we cannot guarantee that there won’t be any cross contamination with your other meals.

 

Food allergy reactions can range from mild to severe. If you have any food allergies we advise you to exercise extreme caution when ordering from EETS ATX. If you have moderate to severe allergies we cannot recommend EETS ATX  for you. EETS ATX  may offer some gluten-free meals but these meals are not prepared in a gluten-free facility. If you have any questions regarding your food allergy, please contact us.

Food Storage.

Once a meal is turned over to the client, it is your responsibility to properly handle and maintain. EETS ATX accepts no responsibility for damages related to meals that have been improperly stored. After meals are delivered they should be refrigerated promptly. Failure to promptly refrigerate meals will absolve EETS ATX  of any liability or responsibility for damages related to meals that have been improperly refrigerated after delivery.

 

EETS ATX  accepts no responsibility for damages related to meals that have been exposed to cross contamination. After meals are delivered they should be refrigerated promptly and above and away from any spoiled, uncooked, or spore ridden foods. Failure to properly store meals will absolve EETS ATX of any liability or responsibility for damages related to meals that have been improperly stored after delivery.

EETS ATX  is not responsible for any illness or death due to manufacturing flaws or recalled products. EETS ATX  will inspect all groceries, but is not responsible for conditions unknown or unforeseen.

 

If it is discovered that a product is contaminated or has been recalled, EETS ATX  will promptly contact you and advise to avoid the item.

 

Food should not be left unrefrigerated for longer than 2 hours.

The terms of this agreement represent an ongoing service provided by the Chef on behalf of the Client.  If either party wishes to revise these terms, changes and edits must be suggested in writing and agreed upon by both parties.  

CLIENTS AND CHEF AGREE TO ABIDE BY THE POLICIES AND PROCEDURES AS LISTED.
